These Terms of Use govern your use of Streamiva. They cover the website at streamiva.net and the Streamiva apps for phones, tablets and TVs. "Streamiva", "we", "us" and "our" mean Streamiva. "You" means the person who holds a Streamiva account or uses Streamiva.
By ticking the box when you set up your account, or by using Streamiva, you agree to these Terms and to our Privacy Statement. If you do not agree, do not use Streamiva.
1. What Streamiva is
1.1. Streamiva is a discovery service. It learns what you like, recommends movies and series that match your taste, and shows you where titles may be available to watch.
1.2. Streamiva supports playback of links supplied by plugins. Your device connects directly to the plugin's media host. Streamiva also operates a starter plugin containing selected public-domain films. Other plugins identify their own operator and sources; the applicable provider's terms govern their services. Hosting a plugin separately does not change who operates it.
1.3. Streamiva is currently free. If we introduce paid features, we will tell you beforehand, and you will not be charged for anything you have not expressly chosen to buy.
2. Eligibility and your account
2.1. You must be at least 18 years old, or the age of majority where you live if that is higher, to create and hold a Streamiva account. When you set up your account, you confirm that you meet this requirement.
2.2. You may create up to five profiles in your account for yourself and members of your household. You are responsible for how every profile in your account is used, including by anyone under 18. Recommendations and title information can include material that is not suitable for children.
2.3. You sign in with a one-time code sent to your e-mail address or phone number. TVs are connected with a pairing code confirmed from a device where you are already signed in. You are responsible for:
- keeping access to your e-mail account, phone and signed-in devices secure;
- keeping your contact details up to date;
- all activity that happens through your account.
2.4. Tell us promptly at the contact address below if you believe someone else has accessed your account. We may ask you to verify that you own the account before we act.
2.5. Your account is personal to you. You may not sell, transfer or share it outside your household.
3. Using Streamiva
3.1. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use Streamiva for your own non-commercial purposes, in line with these Terms.
3.2. You agree not to:
- (a) use Streamiva in a way that breaks any law or infringes anyone's rights, including copyright and other intellectual-property rights;
- (b) copy, scrape, crawl, harvest or systematically extract data, recommendations or title information from Streamiva, by automated means or otherwise;
- (c) use Streamiva, or anything obtained from it, to train, test or improve any machine-learning or artificial-intelligence model;
- (d) reverse engineer, decompile or modify the Streamiva apps, except where the law expressly allows it;
- (e) interfere with, overload or try to gain unauthorised access to Streamiva, its systems or other members' accounts, or circumvent any security or access control;
- (f) create accounts by automated means or under false pretences;
- (g) resell Streamiva or offer it as part of another product or service;
- (h) upload, link to or share anything unlawful, harmful, deceptive or infringing through any feature that accepts your input.
3.3. Recommendations, availability ("where to watch"), ratings, descriptions, images and other title information come partly from third-party sources, such as The Movie Database (TMDB) and JustWatch, and are provided for general information. Availability changes often and differs by country. We do not guarantee that a title is available, on a given service, at a given price or in your region.
3.4. Some links to third-party services may be affiliate links, which means we may receive a commission if you subscribe to or buy from that service. This does not change what you pay.
3.5. We may change, add or remove features, and we may test new features with some members. We may suspend all or part of Streamiva for maintenance, security or legal reasons.
3.6. The apps may update automatically. Some features need a compatible device and an internet connection, which you provide at your own cost.
4. Third-party services, extensions and add-ons
4.1. Streamiva may link to, integrate with, or let you connect or add third-party services, extensions, add-ons, sources or other components that are not provided by Streamiva ("Third-Party Extensions"). This includes extensions made by other developers and ones you configure yourself.
4.2. Third-Party Extensions are provided by their identified operators. Store-distributed apps use Streamiva's reviewed plugin list. A separate community list may be available through the website or independently distributed clients. Inclusion on either list does not grant rights to content or guarantee availability. Plugins operated by Streamiva, including the public-domain starter, are identified as such.
4.3. You are solely responsible for making sure that you have every right, licence and permission needed to access, view or use any content or service you reach through a Third-Party Extension, and that doing so is lawful where you are. Do not add or use any Third-Party Extension to access content you are not authorised to access.
4.4. The Streamiva application backend exchanges plugin metadata and playback-control messages, and returns the media link to your device. It does not relay the video. The media provider receives the requests needed to deliver it, including your network address. A plugin or media service operated by Streamiva remains our service even when it runs on a separate host.
4.5. We may, at any time and without notice, disable, remove, block or restrict any Third-Party Extension or category of extensions, for any reason. Reasons include a notice that an extension infringes someone's rights, a legal requirement, a security risk, or a breach of these Terms. We may also require extensions to meet technical or policy requirements before they can be added.
4.6. Third-Party Extensions are provided "as is". We are not responsible for them, for their availability, security or accuracy, or for any loss or damage arising from their use.
4.7. The public-domain starter is installed once for each profile on its first visit. You may disable or remove it in plugin settings; later sign-ins do not reinstall a removed starter automatically.
4.8. Blocking a plugin stops new playback preparation through Streamiva. A media link already issued by its provider may remain usable until that provider revokes it or it expires.
5. Third-party services, attributions and your consents
5.1. Parts of Streamiva are provided by, or rely on, the third-party services named in this section. Each of them has its own terms and privacy policy. Where this section says that using a feature means agreeing to a third party's terms, using that feature is your consent to those terms. If you do not agree to them, do not use that feature. We do not control these services and are not responsible for them, their content or their availability.
5.2. YouTube. Trailers are played by YouTube's embedded player, which uses YouTube API Services. By playing a trailer, you agree to be bound by the YouTube Terms of Service. Google's Privacy Policy applies to YouTube's player. The player loads only when you play a trailer. While it plays, YouTube (Google) may set cookies, use your device's storage, collect information about your device and what you watch, and show ads. Our Privacy Statement explains what this means for your data. Streamiva does not receive the information YouTube collects. You consent to trailers playing in YouTube's embedded player, and to the cookies it may set, when you tick the box to accept these Terms as you finish setting up your account. You can turn the embedded player off, or back on, at any time in Settings. While it is off, trailers open on YouTube's own website or app instead of playing inside Streamiva, and YouTube's terms and privacy policy apply there.
5.3. The Movie Database (TMDB). Title information, artwork and images are provided by The Movie Database. This product uses the TMDB API but is not endorsed or certified by TMDB. TMDB's Terms of Use apply to that material.
5.4. JustWatch. Streaming availability data ("where to watch") is provided by JustWatch. It is shown for general information and may be incomplete or out of date, as described in section 3.3.
5.5. Sign-in. Your account, sign-in codes and the sign-in e-mails and text messages are handled for us by Supabase, our authentication provider, as described in the Privacy Statement. Your e-mail provider and mobile carrier deliver those messages under their own terms.
5.6. Streaming services and other sites. When you follow a link from Streamiva to a streaming service, a store or another website, or open one of their apps, you leave Streamiva. That service's own terms and privacy policy govern your use of it, including any subscription or purchase you make there.
5.7. Summary of your consents. For clarity, by using Streamiva you consent to the following, each as described in the section named:
- (a) these Terms and our Privacy Statement, which you accept by ticking the box when you set up your account (introduction);
- (b) that you meet the minimum age to hold an account (section 2.1);
- (c) the YouTube Terms of Service, with Google's Privacy Policy applying, each time you play a trailer, and trailers playing in YouTube's embedded player (which may set cookies). You give that consent by ticking the box when you finish setting up your account and can turn it off or on at any time in Settings; while it is off, trailers open on YouTube's own website or app instead (section 5.2);
- (d) the terms of the third-party services and sites you choose to use through Streamiva (sections 4 and 5);
- (e) our use of your ratings, lists, searches and other input to personalise and improve Streamiva (section 6.1);
- (f) receiving communications about your account and these Terms electronically (section 15.1). Marketing e-mails are sent only if you separately opt in, and you can withdraw that consent at any time.
6. Your content and feedback
6.1. Ratings, lists, profile names, searches and other input you provide ("Your Input") stay yours. You grant us a worldwide, royalty-free licence to use, store and process Your Input to operate, personalise and improve Streamiva, as described in the Privacy Statement. This licence ends when you delete Your Input or your account, except for copies we must keep by law or that are in backups awaiting deletion.
6.2. If you send us ideas or feedback, we may use them without any obligation to you.
7. Intellectual property
7.1. Streamiva, including its software, design, recommendation technology, text, logos and the Streamiva name, belongs to us or our licensors and is protected by intellectual-property laws. Except for the limited licence in section 3.1, these Terms give you no rights in it.
7.2. Film and series titles, artwork, trailers and descriptions belong to their respective owners. Section 5 names the sources that provide them to Streamiva.
8. Copyright and infringement notices
8.1. We respect the intellectual-property rights of others and expect you to do the same.
8.2. If you believe that material or a link available through Streamiva, including through a Third-Party Extension, infringes your copyright or other rights, send a notice to the contact address in section 16 with:
- (a) your name and contact details;
- (b) a description of the work you say is infringed;
- (c) where on Streamiva the material or link appears, specific enough for us to find it;
- (d) a statement that you believe in good faith that the use is not authorised by the rights holder, its agent or the law;
- (e) a statement that the information in the notice is accurate and that you are the rights holder or authorised to act for them;
- (f) your physical or electronic signature.
8.3. When we receive a valid notice, we will act promptly. That may include removing or disabling access to the material, link or Third-Party Extension concerned. Where we can, we will tell the member affected. A member who believes material was removed by mistake may send a counter-notice to the same address, explaining why.
8.4. We will suspend or close the accounts of members who repeatedly infringe the rights of others, in appropriate circumstances.
8.5. The copyright and takedown page explains how to send a notice concerning a plugin or media link.
9. Suspension and termination
9.1. You can stop using Streamiva at any time, and you can delete your account in Settings. Deletion is permanent. What we remove and what we keep is described in the Privacy Statement.
9.2. We may suspend or close your account, or restrict features, with or without notice if:
- we reasonably believe you have breached these Terms;
- we are required to by law or by a competent authority;
- your use creates a risk for Streamiva, other members or third parties.
Where it is appropriate and lawful, we will tell you why.
9.3. Sections 4.6, 5, 6.2, 7, 8, 10, 11, 12, 14 and 15 continue to apply after your account ends.
10. Disclaimers
10.1. Streamiva is provided "as is" and "as available". To the fullest extent the law allows, we make no promises that:
- Streamiva will be uninterrupted, error-free or secure;
- recommendations will suit you;
- title or availability information is accurate, complete or current.
10.2. Nothing in these Terms limits rights you have as a consumer that cannot be limited by contract under the law of the country where you live.
11. Limitation of liability
11.1. To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or opportunity. This also covers loss arising from your use of third-party services or Third-Party Extensions, or from content you access through them.
11.2. To the fullest extent the law allows, our total liability to you for all claims relating to Streamiva is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) USD 50.
11.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
12. Indemnity
You agree to compensate us for any claims, losses, liabilities and reasonable costs, including legal fees, that arise from:
- your breach of these Terms or of any law;
- your infringement of anyone's rights;
- your use of Third-Party Extensions or of content accessed through them.
We will tell you about any such claim and let you take part in its defence at your own cost.
13. Changes to these Terms
13.1. We may update these Terms, for example to reflect new features, changes in the law, or how Streamiva works. Each version shows its "Last updated" date.
13.2. If a change is material, we will tell you at least 30 days before it takes effect, by e-mail if we have your address and inside Streamiva. If you keep using Streamiva after the change takes effect, you accept the updated Terms. If you do not accept them, stop using Streamiva and delete your account before that date.
13.3. For some changes, we may ask you to confirm that you accept the updated Terms before you continue using Streamiva on the web or on your phone.
14. Governing law and disputes
14.1. These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law rules. The competent courts of Tel Aviv-Jaffa have exclusive jurisdiction over any dispute arising from these Terms or Streamiva.
14.2. If you are a consumer living in the European Union, the United Kingdom or another country whose law gives you the right to bring proceedings in your own courts or under your own mandatory law, you keep that right.
14.3. Before starting proceedings, please contact us so we can try to resolve the issue informally.
15. General
15.1. Electronic communications. You agree to receive communications about your account and these Terms electronically, by e-mail or inside Streamiva. Marketing e-mails are sent only if you opt in. You can opt out at any time in Settings or through the link in each e-mail.
15.2. Assignment. We may transfer our rights and obligations under these Terms to another entity as part of a reorganisation, merger or sale, provided your rights are not reduced. You may not transfer yours.
15.3. Severability. If any part of these Terms is found invalid or unenforceable, the rest remains in force.
15.4. No waiver. If we do not enforce a right, we have not given it up.
15.5. Force majeure. We are not responsible for failures caused by events beyond our reasonable control.
15.6. Entire agreement. These Terms and the Privacy Statement are the whole agreement between you and us about Streamiva.
15.7. Language. We may provide translations. If a translation conflicts with the English version, the English version governs, except where the law requires otherwise.
